These Terms of Service ("Terms") govern your access to and use of Surge ("the Service"), operated by Mason Bowstead at trysurge.app. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Surge.
Surge is a content management, planning, and analytics dashboard for creators, operators, and agencies. It enables users to plan content, track analytics from connected social media platforms, manage publishing workflows, and generate AI-assisted content.
You must be at least 18 years of age to use Surge. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

The Surge platform, its design, code, and features are the property of Mason Bowstead and are protected by applicable intellectual property laws. You retain ownership of all content you create within Surge. By using the Service, you grant us a limited licence to store and process your content solely to provide the features you use.
Your use of Surge is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
Surge uses Anthropic's Claude AI to generate content suggestions, captions, and insights. AI-generated content is provided as a starting point only. You are solely responsible for reviewing, editing, and deciding whether to publish any AI-generated content. We make no warranties regarding the accuracy, originality, or suitability of AI outputs.
We aim to keep Surge available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or suspend the Service for technical reasons. We are not liable for any loss arising from temporary unavailability.
Surge is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that any analytics data will be accurate or complete.
To the fullest extent permitted by applicable law, Mason Bowstead and Surge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed £100 or the amount you paid us in the 12 months preceding the claim, whichever is greater.
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting us. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 7 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
